Terms & Conditions

These Terms & Conditions ("Terms") are between you and IronWorks Fitness Solutions ("we", "us", "our"), the operator of the Phasework app ("the Service"). By creating an account or continuing to use the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization; otherwise you confirm you are of legal age in your jurisdiction.

Phasework is a self-directed nutrition and health tracking app. It calculates calorie and macro targets for goals such as cutting, bulking, recomposition or maintenance, lets you log daily metrics (weight, food, water, steps, sleep and wellbeing ratings), scores your adherence, and suggests weekly adjustments. Paid tiers (Pro and Elite) unlock extended history, automatic weekly adjustments and additional tracking features.

Phasework is not a medical device and does not provide medical advice. Calculated targets are estimates for general informational purposes; consult a qualified health professional before making significant changes to your diet or exercise.

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account.

You must not misuse the Service. This includes, without limitation:

• Using the Service for any unlawful purpose, or to commit fraud or send spam;
• Infringing intellectual property rights of any third party;
• Interfering with the security or operation of the Service, including introducing malware, probing or scanning for vulnerabilities, or scraping the Service;
• Reverse engineering the Service, reselling or redistributing it, or circumventing technical limits or tier restrictions.

We retain all ownership of the Service and its intellectual property, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected, for your personal use. You retain ownership of the content you enter (such as logs and notes); you grant us a limited license to host and process that content solely to provide the Service to you.

Paid subscriptions are billed monthly in advance and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Payment, billing, tax, cancellation and refund mechanics are handled by our payment provider and are governed by Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms).

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We work hard to keep Phasework reliable, but we do not guarantee that the Service will be uninterrupted or error-free. The Service is provided "as is" and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. When your access ends, your data may be deleted after a reasonable period; you may request an export of your data before deletion by contacting us.

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid us in the 12 months before the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.

You agree to indemnify us against claims arising from content you submit, your unlawful use of the Service, or your violation of these Terms.

You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays or failures caused by events beyond our reasonable control. These Terms are governed by the laws of the jurisdiction in which IronWorks Fitness Solutions is established, and disputes will be resolved in the courts of that jurisdiction. We may update these Terms from time to time; continued use of the Service after changes take effect constitutes acceptance.
